Shutting off the Mercedes-Benz Emergency Call System at customer request, form

Model

118, 167, 223, 247, 290

At the express request of

.............................................................................................

(known hereinafter as "Customer")

on the

.............................................................................................

the Mercedes-Benz emergency call system will be switched off in the following vehicle:

Model:

.............................................................................................

Registration number:

.............................................................................................

Vehicle identification number:

.............................................................................................

Note:

As a consequence of switching off the Mercedes-Benz emergency call system, the vehicle's own communication module is switched to a special mode, which during normal vehicle operation is no longer permanently connected to the mobile phone network. This means that in the event of a manual or automatic triggering of the mandatory European emergency call telephone number (EU emergency call telephone number 112), the communications module must dial into an available network in order to then make the emergency call. In contrast to the Mercedes-Benz emergency call system, this may delay rescue measures from being implemented.

Another consequence of switching off the Mercedes-Benz emergency call system is that services and functions that require an active cellular telephone system connection (e.g. Mercedes me Connect services) cannot be used for this vehicle. The customer is expressly notified of the consequences of the change requested by the customer and is obliged to notify each other user of the vehicle accordingly before handing over the vehicle.

(Copy sheet, cut off here and stick the upper section into the operator's manual at the start of the chapter "Mercedes-Benz emergency call system")

Certificate of compliance, exemption and measures

1.
The customer states that all the circumstances and, where applicable, any hazards associated with the above-mentioned change requested by the customer are known and, in particular, that services and functions that require an active cellular telephone system connection (e.g. Mercedes me connect services) are no longer available, and that rescue measures may be delayed from being implemented. The customer's signature indicates that the customer expressly approved of such a change.

2.
For damage and hazards resulting from the change requested by the customer, Mercedes-Benz AG, its group companies and its sales partners (collectively known as "Mercedes-Benz AG"), shall only be liable if they are caused by an infringement to a significant contractual obligation or to intentional or reckless behavior by Mercedes-Benz AG, its legal representatives or auxiliary persons. If a significant contractual obligation is infringed through ordinary negligence, then liability is restricted to damage foreseeable at the time of concluding the contract. A significant contractual obligation is given in commitments, whose fulfillment makes correct implementation of the contract possible or where the customer expects and is entitled to expect their observance.

Any liability beyond this for compensation is excluded.

The limitations of liability of this section are not valid in the event of injury to life, body, health.

Irrespective of any fault on the part of Mercedes-Benz AG, Mercedes-Benz AG shall remain liable for any liability arising from the assumption of a warranty or a procurement risk, and in accordance with the product liability law (ProdHaftG) or other applicable product liability laws.

3.
The customer states that he shall fully indemnify Mercedes-Benz AG from any quoted third-party claims under (2), which arise directly from the deactivation of the MercedesBenz emergency call system and not from any infringement of a significant contractual obligation or from intentional or reckless behavior by Mercedes-Benz AG, its legal representatives or auxiliary persons.

4.
Furthermore, the customer hereby undertakes:

a)
to ensure that the above-detached supplementary page is always permanently attached to the operator's manual (e.g. glued in) and

b)
to inform other vehicle users in full of the change and the associated circumstances (incl. no availability of Mercedes me connect services) and, where applicable, any hazards resulting from the conversion, and to document this and

c)
have the original state and therefore the function of the Mercedes-Benz emergency call system restored when the vehicle is resold in a qualified specialist workshop only, e.g. an authorized Mercedes-Benz workshop.

The following services and functions that require an active cellular telephone system connection are rendered nonfunctional by the change:

Mercedes me connect

Mercedes me Info Call

All other services/functions that require an active cellular telephone system connection
