Change of equipment at customer request

Dear Customer,
At your specific request the Mercedes-Benz Service Partner immobilized the stability control feature on the above-mentioned vehicle. As a consequence of performing this measure, the stability control function is no longer available and therefore it is no longer effective. Express notification has been issued of the hazards, consequences and, in particular, the risks of injury involved as a result of the immobilization.

Warning!
Immobilization of the stability control means that your vehicle now acts like a vehicle not equipped with stability control in the critical limits of road-holding. The risk of an accident or injury occurring has been thereby increased!

As part of the order placement, neither the Mercedes-Benz Service Partner nor Daimler AG have undertaken any technical inspection of the effects of the immobilization.

Note:
On vehicles equipped with super-wide tires, the stability control may not be immobilized.

Certificate of compliance, exemption and measures

(1)

The customer declared that he is aware of all the hazards and injury risks involved in connection with his requested change, as mentioned above. The customer's signature indicates that the customer expressly approved of such a change.

(2)

The customer is aware that on account of his requested change and - as a consequence - his expressly declared approval of the attendant, increased hazards and risks of injury, no claims can be expressed against Daimler AG, its group member companies or its sales partners (together "DAG"), which arise – directly or indirectly – because of the above-mentioned changes and the related increased risks of injury.

The customer hereby releases DAG from all third-party claims and indemnification as stated under (2).

(4)

Furthermore, the customer is obliged:

(a)

to permanently affix an adhesive label to the instrument panel in a visible area, which indicates that the stability control has been immobilized,

(b)

to ensure that

-

a copy of this form is always included with the operator's manual, and

-

that other users/purchasers of the vehicle are informed thereof,

(c)

that other users/purchasers of the vehicle be notified in full of the change and the related hazards and risks of injury involved, and that this be documented,

(d)

that with the purchase of this vehicle the obligations contained in this declaration by the customer be imposed in full,

(E)

that the purchaser of the vehicle is contractually bound, to also impose any subsequent purchasers of the obligations contained in this customer obligation.
