Due to the deactivation of the ADAPTIVE ESP® which I require, the standard production function of Electronic Stability Program including the additional functions for dynamic and high dynamic maneuvers EUC (enhances understeering control), ROM (roll over mitigation) and RMI (roll movement intervention) in the Sprinter vehicle, vehicle identification number
WDB __________________________________________________ , is rendered inoperative and is therefore no longer effective.
With deactivation of ADAPTIVE ESP® on all-wheel drive vehicles, a 4ETS function (traction control system on all 4 wheels) is retained for technical reasons as a traction control system. In contrast to the ASR of the full system the 4ETS has no engine control, the ASR switch in the vehicle is nonfunctional with 4ETS and the designation is misleading. The switch should therefore be covered with a blind cap.
In particular the danger associated with this measure has been drawn to my attention in the following:

The attached and converted parts to the above-mentioned vehicle commissioned by you mean that the function in accordance with purpose of ADAPTIVE ESP® is no longer guaranteed and has had to be deactivated.
As a result your vehicle behaves at the critical limits of road-holding like a vehicle without ESP.
I hereby renounce all claims against DaimlerChrysler AG and the workshop stated which might result from the deactivation of the ADAPTIVE ESP® , regardless of basis in law.
Furthermore, I undertake to draw the attention of any driver, any subsequent purchaser of the vehicle or any person to whom the vehicle is transferred for use or other purpose, to the fact that ADAPTIVE ESP® has been deactivated and to the above-mentioned safety risks associated with this and the measures required. The prescribed mode of conveying this information will be by providing such persons with a copy of this statement. I will also ensure that this declaration is always inserted in this operating manual and inform any future purchasers of the vehicle of this fact.
I furthermore undertake to attach an adhesive label to the ESP control unit and the dashboard in a visible and permanent manner, to draw attention to the above- mentioned deactivation of the ADAPTIVE ESP® and the associated instructions.
